1. TRATAMIENTO PENAL DE LOS DELITOS DE SUSTANCIAS DESTINADAS AL USO PÚBLICO Y DELINCUENCIA FARMACÉUTICA
CRIMINAL TREATMENT OF CRIMES INVOLVING SUBSTANCES INTENDED FOR PUBLIC USE AND PHARMACEUTICAL CRIME

RESUMEN
Es una investigación que aborda los delitos de ingestión de sustancias envenenadas, contaminadas, alteradas o corrompidas, como son el alimento, medicina, excipiente o materia prima y agua potable destinadas al uso público, conductas de corte clásico que tienen por objeto proteger la salud pública, determinando que Panamá carece de una estructura normativa pertinente para enfrentar los nuevos riesgos y amenazas a la salud pública por medicamentos falsificados, caducados o adulterados, entre otros, que no cumplen con los estándares de calidad. Estos delitos farmacológicos que son una expresión de la delincuencia organizada, comprenden conductas de fabricación, almacenamiento, comercialización, falsificación y tráfico ilícito de medicamentos que requieren de una configuración legal en la legislación vigente, ante la ausencia de tipos penales concretos que combatan la delincuencia farmacéutica que tiene impacto en la salud pública, hecho que tiene abordarse conjuntamente con herramientas preventivas sanitarias.
ABSTRACT
This investigation addresses the crimes of ingesting poisoned, contaminated, altered, or corrupted substances, such as food, medicine, excipients or raw materials, and drinking water intended for public use. These are classic offenses aimed at protecting public health. The investigation determines that Panama lacks a relevant regulatory framework to address the new risks and threats to public health posed by counterfeit, expired, or adulterated medicines, among others, which do not meet quality standards. These pharmaceutical crimes, which are an expression of organized crime, encompass the manufacture, storage, sale, counterfeiting, and illicit trafficking of medicines. Given the absence of specific criminal offenses to combat pharmaceutical crime, which impacts public health, these crimes require legal definition within current legislation. This situation must be addressed in conjunction with preventative health measures.

RESUMEN
Durante la segunda mitad del siglo XX, los avances científico-técnicos convirtieron a las sociedades modernas en sociedades del riesgo y dieron origen a una progresiva expansión del Derecho penal. El ámbito de la seguridad vial es considerado un ejemplo paradigmático de ello. Ahora, debido al desarrollo de la inteligencia artificial, la posible generalización de la conducción autónoma plantea nuevos riesgos cuya gestión parece corresponder al Derecho penal. ¿Nos encontramos ante un nuevo paradigma para los delitos contra la seguridad vial? ¿Qué aplicabilidad tiene frente a este nuevo contexto nuestra legislación penal? ¿Es necesario tipificar nuevas conductas? O, en última instancia, ¿quién debe responder de los daños a bienes jurídico-penales que ocasione un vehículo completamente autónomo? El presente trabajo trata de responder a estas y otras cuestiones, aunque sin olvidar que toda intervención penal debe llevarse a cabo respetando sus fundamentos básicos y los límites de su actuación.
ABSTRACT
During the second half of the 20th century, scientific and technological advances transformed modern societies into risk societies and led to a progressive expansion of Criminal Law. The field of road safety is considered as a paradigmatic example of this phenomenon. Now, due to the development of artificial intelligence, the potential widespread use of autonomous driving introduces new risks whose management appears to fall within the scope of Criminal Law. Are we facing a new paradigm for road safety offences? How applicable is our criminal legislation to this new context? Is it necessary to define new offences? Or, ultimately, who should be held liable for the harm caused to legal goods by a fully autonomous vehicle? This paper seeks to address these and other questions, without forgetting that any Criminal Law intervention must be carried out with full respect for its foundational principles and the limits of its scope.

RESUMEN
El artículo analiza la política de persecución penal estratégica como instrumento de gobierno institucional del Ministerio Público en el Estado democrático de derecho. Examina los principios que la política criminal transmite a la función persecutoria, los elementos constitutivos de una política bien formulada y su manifestación diferenciada según la gravedad de los delitos, con base en los principios de obediencia jerárquica y unidad de actuación que articulan la aplicación institucional de los lineamientos. Desarrolla los mecanismos alternativos y la justicia restaurativa para delitos de menor lesividad y analiza el proceso de construcción, validación y monitoreo de la política. Concluye que su legitimidad democrática depende de su apertura a la participación social y de su disposición a rendir cuentas ante la ciudadanía.
ABSTRACT
This article examines strategic criminal prosecution policy as an institutional governance instrument for the Public Prosecutor's Office within the democratic rule of law. It analyzes the principles that criminal policy transmits to the prosecutorial function, the constitutive elements of a well-formulated policy, and its differentiated expression by offense severity, grounded in the principles of hierarchical obedience and unity of action governing the institutional application of prosecutorial guidelines. It develops alternative dispute resolution mechanisms and restorative justice for lower-severity offenses and analyzes the policy's construction, validation, and monitoring. It concludes that democratic legitimacy depends on openness to social participation and accountability to citizens.

RESUMEN
En este estudio descriptivo y documental que se propone identificar, catalogar y valorar los ámbitos de afectación de los derechos humanos en la violencia de género contra las mujeres, que es facilitada por la tecnología, desde las formas más conocidas y frecuentemente cometidas en la red que tienen efectos en el bienestar general, el derecho a la paz y en el derecho de la mujer a vivir una vida libre de violencia digital. Se determina que este fenómeno global de violencia estructural machista debe ser abordado de manera integral, y que preferiblemente, la estrategia educativa con énfasis en la educación en derechos humanos puede ser además, de las anteriores la más acertada en la construcción de un espacio digital libre de violencia contra la mujer.
ABSTRACT
In this descriptive and documentary study it aims to identify, categorize, and assess the areas where digital gender-based violence against women, facilitated by technology, affects human rights. It examines the most well-known and frequently committed forms of online violence, impacting general well-being, the right to peace, and women's right to live a life free from digital violence. The study concludes that this global phenomenon of structural male violence must be addressed comprehensively, and that an educational strategy with an emphasis on human rights education may be the most effective approach for creating a digital space free from violence against women.

5. COMPRENDER LA DIFUSIÓN NO CONSENTIDA DE MATERIAL ÍNTIMO: APORTACIONES DESDE EL ANÁLISIS DESAGREGADO DE SENTENCIAS ESPAÑOLAS
UNDERSTANDING THE NON-CONSENSUAL DISSEMINATION OF INTIMATE MATERIAL: INSIGHTS FROM A DISAGGREGATED ANALYSIS OF SPANISH COURT RULINGS

RESUMEN
El objetivo de este trabajo es obtener un conocimiento exploratorio de la difusión no consentida de material íntimo (sexting secundario) en España mediante el análisis de 130 sentencias penales (artículo 197.7 CP) resueltas entre 2015 y 2023. Los resultados revelan un patrón de género marcado: los autores son mayoritariamente hombres (92,3%) que actúan en solitario, difundiendo sin consentimiento contenido sexual de mujeres (93,1%). El vínculo predominante entre el victimario y la víctima era una relación afectivo-sexual ya finalizada (exparejas) (49,2%). La difusión se realiza principalmente mediante fotos (74,6%) a través de WhatsApp (46,9%) a más de diez destinatarios (52,3%). A diferencia de otros estudios, las motivaciones más frecuentes en sede judicial son la humillación, la ruptura de pareja y la venganza, lo que subraya el carácter intencional y dirigido del daño en los casos que alcanzan el sistema penal. Estos hallazgos son esenciales para el desarrollo de estrategias preventivas y políticas criminales eficaces.
ABSTRACT
The objective of this study is to offer an exploratory understanding of the non-consensual dissemination of intimate material (secondary sexting) in Spain through the analysis of 130 criminal court rulings (Article 197.7 CP) resolved between 2015 and 2023. The results reveal a marked gender pattern: perpetrators are predominantly men (92.3%) acting alone, non-consensually disseminating sexual content of women (93.1%). The predominant relationship between the perpetrator and the victim was a ceased affective-sexual one (ex-partners) (49.2%). Dissemination is mainly carried out through photos (74.6%) via WhatsApp (46.9%) to more than ten recipients (52.3%). Unlike other studies, the most frequent motivations in court rulings are humiliation, relationship breakdown, and revenge, which underscores the intentional and targeted nature of the harm in cases that reach the penal system. These findings are essential for developing effective prevention strategies and criminal policies.

RESUMEN
El estudio ofrece una visión crítica de la transformación de la política criminal europea para responder a los procesos de radicalización de inspiración yihadista, pasando por el tránsito de enfoques teóricos centrados en la comprensión de las causas profundas del terrorismo hasta la reciente Estrategia ProtectEU (2025). De esta manera, el autor presenta un análisis sobre la consolidación de modelos de contención anticipatoria basados en el uso de herramientas de soft law acompañadas de la predicción tecnológica como herramienta de vigilancia masiva derivada del uso de inteligencia artificial. Este enfoque tecnológico refuerza la consolidación de un Derecho Penal de la peligrosidad que podría sustituir la comprensión de los factores desencadenantes de la radicalización por la predicción puramente estadística.
ABSTRACT
The research provides a critical analysis of the transformation of European criminal policy in response to jihadist-inspired radicalization, from theoretical approaches focused on understanding the root causes of terrorism up to the recent ProtectEU Strategy (2025). In this regard, the author analyzes the consolidation of anticipatory containment models based on the use of soft law tools, accompanied by technological prediction as a tool for mass surveillance based on artificial intelligence. This technological perspective reinforces the consolidation of a “danger-based” criminal law that could replace the understanding of the factors that trigger radicalization with purely statistical prediction.

RESUMEN
El término «transformación digital» se refiere, en sentido amplio, a los procesos de cambio provocados por la digitalización. Abarca nuevas posibilidades de actuación y modelos de negocio, así como cambios duraderos en la economía, la sociedad, la política, el derecho, entre otros ámbitos. Este artículo aborda cuestiones relacionadas con la relación entre el derecho y la digitalización.
Los recientes avances del aprendizaje automático y la inteligencia artificial nos proporcionan las herramientas para construir los modelos predictivos que pueden utilizarse para producir patrones que impulsen a decisiones judiciales. Estas herramientas, pueden ser útiles para los diferentes sujetos jurídicos es decir tanto para abogados, fiscales o jueces, como herramienta de ayuda para identificar rápidamente casos y extraer patrones que conduzcan a determinadas decisiones.
Este artículo presenta aspectos relacionados a la delimitación actual de la clasificación de dichas herramientas, el contenido de las predicciones, así como el análisis de los límites y riesgos que presenta el factor predictivo. Esto es importante ya que afecta significativamente decisión no son comprensibles y no guardan correlación con las cuestiones jurídicas reales del caso. Estos aspectos están relacionados entre algoritmos y la transparencia, ética, lenguaje y confianza de los usuarios, que deberán ser tenidos en cuenta ya que existe una necesidad global de introducir normas armonizadas, control de calidad y responsabilidad, así como directrices éticas para las herramientas predictivas.
ABSTRACT
The term “digital transformation” refers, in a broad sense, to the processes of change brought about by digitization. It encompasses new opportunities and business models, as well as lasting changes in the economy, society, politics, and the law, among other areas. This article addresses issues related to the relationship between the law and digitization.
Recent advances in machine learning and artificial intelligence provide us with the tools to build predictive models that can be used to produce patterns that drive judicial decisions. These tools can be useful for different legal professionals, including solicitors, prosecutors, and judges, as an aid to quickly identify cases and extract patterns that lead to certain decisions. This article presents aspects related to the current delimitation of the classification of such tools, the content of predictions, and an analysis of the limits and risks presented by the predictive factor. This is important because it significantly affects decisions that are not comprehensible and do not correlate with the actual legal issues of the case. These aspects are related to algorithms and transparency, ethics, language, and user trust, which must be taken into account as there is a global need to introduce harmonised standards, quality control, and accountability, as well as ethical guidelines for predictive tools.

RESUMEN
Este estudio analiza la percepción social de la ocupación ilegal de viviendas y su relación con la inseguridad subjetiva en el municipio de Puçol (Valencia, España). Mediante un diseño cuantitativo, descriptivo y transversal, se recogieron datos a través de un cuestionario online administrado a 308 personas mayores de edad con vinculación al municipio. Los resultados muestran que la ocupación ilegal es percibida como un fenómeno extendido y en aumento, con un impacto negativo en la calidad de vida y en la percepción de inseguridad, especialmente entre mujeres y personas de edad avanzada. Asimismo, se identifica una valoración mayoritariamente crítica de la respuesta institucional, caracterizada por bajos niveles de satisfacción y efectividad percibida. Pese a la presencia de miedo al delito y conductas de evitación espacial, la valoración general de la seguridad en Puçol resulta mayoritariamente positiva, evidenciando una percepción ambivalente de la seguridad. El estudio subraya la relevancia de la inseguridad subjetiva como objeto de análisis criminológico y la necesidad de estrategias integrales adaptadas al contexto local.
ABSTRACT
This research examines the social perception of illegal occupation of dwellings and its relationship with perceived insecurity in the municipality of Puçol (Valencia, Spain). Using a quantitative, cross-sectional and descriptive design, data were collected through an online questionnaire administered to 308 adult participants linked to the municipality. The results show that illegal occupation is widely perceived as an extended and increasing phenomenon, with a negative impact on quality of life and subjective insecurity, particularly among women and older adults. The findings also reveal a predominantly critical assessment of the institutional response, characterised by low levels of satisfaction and perceived effectiveness. Despite the presence of fear of crime and avoidance behaviours, the general evaluation of safety in Puçol remains mostly positive, reflecting an ambivalent perception of security. Overall, the study highlights the relevance of subjective insecurity as a criminological phenomenon and underlines the need for integrated strategies combining legal intervention, situational prevention and institutional communication at the local level.

RESUMEN
La violencia sexual constituye un fenómeno complejo que exige una comprensión interdisciplinaria desde la criminología contemporánea. Este artículo analiza el consentimiento como categoría criminológica central para distinguir entre prácticas sexuales legítimas y conductas delictivas, integrándolo con teorías como la neutralización, el aprendizaje social, el desarrollo criminal, la actividad rutinaria y la elección racional. Por lo tanto, se examinan las estructuras de poder, la desigualdad de género, la masculinidad hostil y la presencia de parafilias coercitivas como factores que influyen en la transgresión del consentimiento. A partir de una revisión crítica, se argumenta que las distorsiones cognitivas, la normalización cultural de la coerción sexual y los déficits de empatía contribuyen a la persistencia de la violencia sexual. El estudio concluye destacando la necesidad de fortalecer la educación sexual integral, las estrategias preventivas y las políticas públicas orientadas a promover la autonomía sexual y la erradicación de mitos sobre el consentimiento.
ABSTRACT
Sexual violence is a complex phenomenon that requires an interdisciplinary understanding grounded in contemporary criminology. This article examines sexual consent as a central criminological category for distinguishing legitimate sexual practices from criminal behaviors, integrating theoretical perspectives such as neutralization theory, social learning, developmental criminology, routine activity theory, and rational choice. It also explores how power structures, gender inequality, hostile masculinity, and coercive paraphilias contribute to violations of consent. Through a critical review, the study argues that cognitive distortions, cultural normalization of sexual coercion, and empathy deficits play a crucial role in the persistence of sexual violence. The article concludes by emphasizing the importance of strengthening comprehensive sexual education, preventive strategies, and public policies aimed at promoting sexual autonomy and dismantling myths surrounding consent.
